![]() If so, Collins ruled that the termination attempt “could not constitute claims against Charles’ estate and therefore could not have breached the agreement between Charles and Defendants.”īut that doesn’t end things in the complicated ruling. If Charles’s songs were not made for hire, and he owned them when he died, the judge says that the “Copyright Act prevents the Court from interpreting the agreements signed by Defendants as limiting their statutory termination rights” - in other words, when Ray Charles gathered his children and gave them $500,000 and no more, the agreement couldn’t include a waiver against termination because that would be something known in legal parlance as an “agreement to the contrary,” which some past courts in California have ruled is unenforceable so far as termination attempts go.Īnd if Charles actually did work for Atlantic/Progressive and didn’t own his songs at any point? The foundation wavered on the issue, so the judge addressed both possibilities. Again, that goes to the issue of whether the songs are eligible to be terminated in the first place. ![]() Collins gave a few reasons why the foundation won’t likely succeed.Ī key issue in the possibility of termination is whether or not Charles’ songs were written as works made for hire and whether he was employed by Atlantic Records and Progressive Music Publishing at the time he composed them. ( Read the ruling in full here.)Īs such, for the lawsuit to go further, it was the foundation’s burden to prove it had a likelihood of prevailing in the case. District Court Judge Audrey Collins‘ ruling last week is that the anti-SLAPP statutes - which give recourse to defendants dragged into litigation that interferes with First Amendment rights - applies to a termination notice because it is “certainly more than simply ministerial and involves more than just a private business transaction,” according to the judge. The first bit of precedent coming from U.S. In reaction to the lawsuit, the children, represented by attorney Marc Toberoff, brought an anti-SLAPP motion, urging the court to reject the claims. Further, the foundation sought a declaration that the termination notices were invalid. ![]() Years later, when the children attempted to grab back rights to Charles’ songs under the termination clauses of copyright law, the foundation sued, alleging that the children had breached their agreements with their father. When he died in 2004, Charles left most of his estate to the Ray Charles Foundation, a charity that supports the vision- or hearing-impaired.Īs for Charles’ children, before he died, the singer gathered most of them (two were in jail) and told them that they each would be given an irrevocable trust for $500,000 - and that’s all they’d get. ![]() That brings our attention to a ruling made Friday by a California federal judge concerning a termination attempt on many of Ray Charles‘ famous songs including “I Got a Woman,” “A Fool for You” and “Mary Ann.”Ĭharles’ 12 children have just survived the first big challenge in their termination attempt. If a musician is deemed as having been employed by the publisher, then the songs originally belonged to the publisher, and no right to terminate exists. There are still potential roadblocks including the possibility that record labels and song publishers will challenge terminations as improper because the songs were made-for-hire. ![]()

![]() Newton developed addiction problems and suffered massive psychological and emotional trauma resulting from the decline of the Black Panther Party, and was shot and killed by a drug dealer on August 22, 1989.ĭespite this sad and untimely death, Huey Newton and the organization that he helped found played a major role in helping the African-American nation increase its knowledge of and pride in self. By 1980, the Black Panther Party for Self Defense was a shell of what it was 10 years before, and officially had disbanded by 1983. Newton was also a serious scholar, obtaining a B.A. Crowds in Tienanmen Square held banners and posters welcoming Newton to China and expressing solidarity and support for the Black Panthers’ struggle. He was welcomed to the People’s Republic of China in September 1971, where he met with Tanzanian and North Vietnamese delegations, Premier Chou En-lai, and Jiang Qing, who was Mao Zedong’s wife. ![]() Newton became an international cause célebre. Newton was freed after his conviction was overturned in May of 1970. However, a massive “Free Huey” campaign invigorated the Black Panther Party, raised large amounts of money, and produced extreme amounts of publicity regarding his case. Eventually, he was convicted of voluntary manslaughter in 1968 and was sentenced to two to fifteen years in prison. ![]() Newton was taken to the hospital, where he suffered further extensive injuries at the hands of vengeful police officers. Huey Newton was charged with murdering police officer John Frey, a well-known racist, on the morning of October 28, 1967, in an incident in which he also was wounded. Law enforcement officials also conducted a myriad of other illegal activities under the auspices of the COINTELPRO program, which disrupted and destroyed the activities of revolutionary groups that were seen as a threat to the capitalist dominance and “good order” of the United States. In 1969, Panthers Bunchy Carter and John Huggins were slain at the UCLA campus during one such incident. Police officers and FBI agents routinely beat Panthers, broke into and illegally searched for materials from their offices and residences, and provoked other organizations to murder members. From the very beginning, the Party attracted substantial monitoring and harassment from local, state, and eventually, federal law enforcement agencies. Branches were opened in several major cities around the country, ranging from Denver to New York City to Chicago to Atlanta. The Black Panther Party for Self Defense grew rapidly and acquired a respected position within the community. Newton also worked hard to address issues of poverty in the community by organizing food pantries, schools, and free health clinics to fill gaps that the capitalist state left behind. He began visiting gambling dens, pool halls, bars, and other locations where members of the black unemployed and working class were massed, and eventually acquired a substantial base for the organization. The Black Panther Party came from Newton and Seale’s desire to defend their community in Oakland from police abuses and wanton violence. This knowledge would go on to become the ideological basis of the Black Panther Party for Self Defense, which he founded with friend and fellow Merritt student, Bobby Seale, in October 1966. He also read voraciously, devouring works by Marx, Lenin, Mao, Castro, Malcolm X, Émile Durkheim, Frantz Fanon, and other revolutionary figures. ![]() He became a well-known figure on campus due to his key role in the Afro-American association, a black fraternity, and working to get a Black history class on campus.
